1. DESCRIPTION OF GOODS AND SERVICES
The Artist agrees to create and deliver the following custom crochet goods (“Product”):

2. PAYMENT TERMS
The total price for the custom crochet commission is $__________________ (Total Price), and payment will be made according to the following terms:
- Deposit:
A non-refundable deposit of 50% of the total price ($__________________) is required upfront to begin the work.
Payment methods: PayPal, Credit Card (via PayPal), Venmo, or other options as agreed. - Final Payment:
The remaining balance of 50% ($__________________) is due upon completion of the commission, prior to delivery. - Late Fees:
A late fee of $5 per day will be applied if the final payment is not received within 7 days of the estimated delivery date. - Refund Policy/Cancellations:
- Before Work Begins: Cancellations are accepted within 48 hours of placing your order for a full refund of the deposit.
- After Work Begins: Once work has started, the deposit is non-refundable. Any work completed will be paid for by the Client, and the Product will be delivered as-is if possible.
3. SHIPPING & DELIVERY
- Shipping Costs:
The Client agrees to cover all shipping costs, which will be calculated based on the Client’s location and the size/weight of the item.
The shipping fee will be communicated to the Client before final payment. - Shipping Method:
The Artist will use __________ (e.g., USPS, FedEx) to ship the Product. Estimated delivery time is 2-5 business days (subject to carrier delays). - Shipping Insurance:
Insurance is not included in the standard price. If you wish to purchase shipping insurance, please inform us before shipment. We are not responsible for loss, damage, or theft once the item has shipped unless insurance is purchased. - Shipping Address:
The Client is responsible for providing an accurate and complete shipping address. The Artist is not responsible for issues arising from incorrect or incomplete addresses.
4. TIMELINE
- Estimated Completion Date:
The Artist will complete the commission by _________________, and the Client will be notified once the Product is ready for shipping. - Delays:
If there are unexpected delays, the Artist will inform the Client and provide a revised timeline. The Artist is not responsible for delays once the item has been shipped.
5. QUALITY & CHANGES
- Customizations:
The Client may request up to _____ revisions or adjustments to the initial design before work begins. Additional revisions may be subject to an additional fee. - Quality of Product:
Due to the handmade nature of items, slight variations in color, size, and appearance may occur. These variations are not considered defects.
The Artist agrees to use high-quality materials and craftsmanship. - No Returns or Exchanges:
All sales are final, as these are custom orders. In the event of damage or loss during shipping, please contact the carrier directly to file a claim.
6. COPYRIGHT & OWNERSHIP
- Intellectual Property:
The Artist retains full rights to all designs, patterns, and intellectual property used to create the Product. The Client does not have the right to reproduce, sell, or distribute the design without express written consent from the Artist. - Photography Rights:
The Artist may take photos of the completed Product for portfolio, marketing, and social media purposes. If the Client prefers their name or likeness not be used in these photos, they must inform the Artist in writing prior to the start of the project.
7. LIABILITY & DISPUTES
- Limitation of Liability:
The Artist is not responsible for any damages, injuries, or losses that occur during the use of the Product after delivery. The Client agrees to use the Product responsibly. - Disputes:
Any disputes arising out of or related to this Agreement will be resolved through mediation in the jurisdiction of Austin, Texas. Both parties agree to submit to the exclusive jurisdiction and venue of the courts located in Austin, Texas.
8. MISCELLANEOUS
- Entire Agreement:
This Agreement constitutes the entire understanding between the Artist and Client. Any amendments or changes to this Agreement must be made in writing and signed by both parties. - Force Majeure:
Neither party will be held liable for delays or failure to perform due to unforeseen circumstances such as natural disasters, shipping issues, or health emergencies.
